It is the same song but it's been rerecorded. The tempo is a bit different, as is the backing vocals.
Or at least that's what one of his band members told me.

You can hear the new version of "It's A Shame", as well as several other songs from the new CD, on the Hayes Carll section of losthighwayrecords.com. It's a little slower and has some very nice steel guitar and 6 string guitar work added. A much more country feel than the original.
